Party wall notices in conservation areas and listed buildings

A conservation area or listed building does not change your duties under the Party Wall Act — but it adds separate heritage consents (planning, listed building consent) you must also obtain.

The short answer

The Party Wall etc. Act 1996 applies in exactly the same way in a conservation area, or to a listed building, as anywhere else — it is a separate regime from heritage controls. What changes is that you will also need the relevant heritage consents: conservation-area planning controls, and listed building consent for a listed property, on top of any party wall notices. The two run in parallel; one never replaces the other.

Why it matters

Conservation areas restrict permitted development and add planning requirements, and listed buildings need listed building consent for alterations — carrying out listed work without it can be a criminal offence. None of that affects whether you must serve a party wall notice: if the work touches a party wall, the boundary or a neighbour’s foundations, you still serve. In practice, heritage work often means more careful methods and a more detailed schedule of condition, which is valuable where the neighbouring property is also historic. The materials and methods specified for heritage reasons simply get reflected in the party wall award. Allow time for both processes to run together.

What to do now

  • Secure planning and (if listed) listed building consent separately — the Act does not cover them.
  • Check whether the Act applies and serve notices; where a surveyor is needed, a single agreed surveyor for both owners is the route Coburns recommends.
  • Allow extra time, and make sure a thorough schedule of condition is taken.

  • Assuming heritage consent covers the party wall position.
  • Assuming the Act is waived for listed buildings.
  • Starting listed work without listed building consent.
  • Underestimating how long the parallel processes take.
